1. Agreement and scope
These Terms of Service (the “Terms”) are an agreement between Core Infinite LLC, doing business as RouteKite (“RouteKite,” “we,” “us,” or “our”), and the person or organization that creates an account, accepts these Terms, accesses the Service, or authorizes another person to do so (“Customer,” “you,” or “your”). If you use RouteKite for an organization, you represent that you have authority to bind it.
These Terms govern RouteKite’s hosted email delivery, campaign, audience, template, asset, reporting, developer, API, support, billing, and account-management tools, including free trials, paid plans, top-ups, and beta features (collectively, the “Service”). They incorporate our Privacy Policy and Acceptable Use Policy. A separately signed written agreement controls only where it expressly conflicts with these Terms.
By using the Service, you accept these Terms. If you do not agree, do not use the Service.

3. Eligibility and authority
You must be at least 18 years old and legally able to enter into a binding contract. You may not use the Service if law prohibits it, you are subject to applicable trade restrictions, or RouteKite previously terminated your access for a material violation.
You are responsible for ensuring that each invited user is authorized to access the relevant Workspace. Maintain current membership and permissions, promptly remove access that is no longer authorized, and keep at least one Workspace owner with authority to manage the Workspace.
4. Accounts and workspaces
You must provide accurate, current, and complete registration, billing, and contact information. We may use the Account email address and authorized users for security, operational, legal, and billing notices.
You are responsible for safeguarding passwords, API keys, recovery codes, devices, and Workspace access. Do not share credentials except through approved Workspace controls. Notify us promptly if you suspect unauthorized access, credential exposure, or an incident involving the Service. You remain responsible for activity through your Account to the extent caused by your failure to protect or supervise it.
Workspace owners control members and roles. RouteKite is not responsible for disputes among Workspace members, personnel, customers, or Recipients.
5. The Service
RouteKite provides tools to create, submit, manage, and understand email. We may reasonably change the Service to protect security, comply with law, maintain deliverability, improve reliability, or develop features. We do not promise that every feature will always be available or that every Message will be delivered, read, or placed in an inbox.
Customer controls the Messages it submits, including content, sender, Recipients, timing, links, and audience selection. Customer is solely responsible for reviewing every Message before submission and for ensuring that it is lawful, accurate, appropriately authorized, and suitable for its Recipients.
Features may be unavailable, delayed, restricted, or paused because of domain or sender verification, recipient status, payment status, security controls, volume limits, abuse signals, or external systems. We may apply reasonable safeguards without prior notice when needed to protect Recipients, RouteKite, or other customers.
6. Customer Data and content
Customer retains its rights in Customer Data. Customer grants RouteKite and its service providers a non-exclusive, worldwide right to host, copy, transmit, process, display, format, and otherwise use Customer Data only as necessary to provide, secure, support, improve, and enforce the Service, comply with law, and respond to valid legal process.
Customer represents and warrants that it has all rights, notices, permissions, lawful bases, and consents needed to submit Customer Data, use every asset, and send each Message. Customer is responsible for the legality, quality, integrity, accuracy, and appropriateness of Customer Data and for retaining compliance records.
You may not submit content that is unlawful, deceptive, infringing, defamatory, exploitative, threatening, abusive, or malicious. We may remove or restrict content when we reasonably believe it violates these Terms, threatens security, creates legal risk, or threatens deliverability.
7. Email compliance
Customer must comply with every law governing its commercial, transactional, political, nonprofit, and other email. This includes obtaining consent or another lawful basis where required, honoring opt-outs, keeping required disclosures, providing a valid physical address where required, and using accurate sender, subject, and reply information.
Marketing Messages may be sent only to Recipients who have affirmatively consented where consent is required or who otherwise may lawfully receive the Message. Customer must preserve reliable consent evidence, including source, date, method, and scope where applicable. Purchased, rented, scraped, harvested, guessed, appended, brokered, or third-party lists are prohibited unless Customer can demonstrate a direct and legally sufficient permission relationship for the intended use.
Customer must promptly honor unsubscribes, suppression requests, complaints, and similar preferences. A transactional message must be genuinely transactional and may not disguise marketing content.
8. Anti-abuse, spam, scam, and fraud rules
RouteKite is not a tool for spam, scams, fraud, impersonation, or abusive messaging. Customer must use the Service in a way that protects Recipients and the email ecosystem. The following are prohibited, whether attempted directly or through an affiliate, contractor, automated workflow, or API client:
- unsolicited bulk email, false consent records, or messages to scraped, harvested, guessed, purchased, rented, appended, or brokered addresses without a lawful direct permission basis;
- forging, spoofing, or deceptively representing a sender, domain, organization, relationship, subject line, reply address, link destination, or identity;
- phishing, credential theft, malware delivery, advance-fee fraud, investment scams, romance scams, employment scams, fake invoices, payment diversion, extortion, or impersonation;
- using lookalike domains, deceptive redirects, hidden destinations, tracking parameters, images, or copy to mislead a Recipient;
- using the Service to facilitate unlawful discrimination, violence, self-harm, financial crime, surveillance, identity theft, or prohibited content;
- evading complaint, bounce, suppression, verification, payment, rate, or reputation controls by rotating domains, addresses, Workspaces, Accounts, credentials, or recipient lists; or
- asking or helping another person to do anything prohibited by these Terms.
We may investigate suspected abuse, review relevant Account and Message metadata, limit or pause sending, cancel pending Messages, preserve records, remove access, and cooperate with lawful requests. We may act on reasonable risk indicators and need not wait for a complaint, legal finding, or completed investigation before applying protective measures.
9. Domains, credentials, and API use
Customer may configure only domains, sending addresses, and reply addresses that it owns or is expressly authorized to use. Customer is responsible for publishing and maintaining domain records, protecting domain accounts, and keeping configured identity information accurate. Domain verification does not grant rights in a domain or guarantee delivery or inbox placement.
API keys are confidential credentials. Create keys with the minimum scopes needed, keep them out of client-side code and public repositories, and delete an exposed key immediately. Customer is responsible for all API activity performed using its keys. RouteKite may restrict keys, payloads, files, requests, or rates to protect security, reliability, Recipients, and the Service.
Use documented interfaces within published limits. Do not rely on undocumented behavior, bypass authentication, submit malicious payloads, scrape the Service outside documented interfaces, or use the Service to create a competing delivery service.
10. Assets and attachments
Customer is responsible for every asset and attachment it uploads, references, or sends. Customer must have all rights needed to store, display, process, and distribute each file. Files may be subject to type, size, storage, retention, and security restrictions and may be rejected or unavailable when unsafe, unsupported, inaccessible, or non-compliant.
You may not use assets or attachments to transmit malware, executable code, prohibited content, unlawful personal data, or material designed to evade security systems. Files needed for queued delivery may be retained temporarily to support delivery and retries. Recipient copies remain outside RouteKite’s control after delivery.
11. Records and reporting
The Service may show submission, delivery, bounce, complaint, delay, suppression, campaign, account, billing, and other operational events. Those records may be delayed, incomplete, deduplicated, corrected, or affected by receiving systems. They are not a guarantee of delivery, inbox placement, reading, clicking, conversion, legal compliance, or business outcome.
Message versions, audit records, financial records, and delivery records may be preserved for security, reliability, legal compliance, dispute resolution, and integrity reasons, including after Customer deletes a related editable item. Customer must independently retain records it needs for legal, accounting, regulatory, or evidentiary purposes.
12. Third-party services and links
The Service may interoperate with third-party payment processors, domain providers, inbox providers, authentication providers, or other services. Those services are operated by their providers and may have separate terms, policies, availability, data practices, or fees. RouteKite is not responsible for third-party services, content, outages, policies, or decisions.
Customer chooses whether to connect a third-party service and authorizes RouteKite to exchange Customer Data with that service only as needed to fulfill Customer’s instruction. Review third-party terms and privacy notices before enabling an integration or following an external link.
13. Billing, plans, trials, and credits
Paid features require a valid payment method, an active plan, or prepaid top-up credit where applicable. Prices, allowances, usage rates, renewal dates, trial conditions, credit expiry, and restrictions are presented in the Service or applicable order flow. Customer authorizes charges for selected subscriptions, usage, top-ups, taxes, and other authorized charges.
Subscription charges are generally billed in advance. Usage may be calculated after use or deducted from an applicable allowance or top-up balance. Plan allowances and top-up credits are distinct, may have different expiry conditions, and are non-transferable. Except where required by law or expressly stated in writing, fees, consumed credits, and unused allowances are non-refundable.
Customer is responsible for applicable taxes other than taxes based on RouteKite’s net income. If payment fails, is disputed, is reversed, or becomes overdue, we may retry it, limit features, suspend service, or require another payment method.
14. Suspension and termination
Customer may stop using the Service at any time and may cancel a paid plan through the Service where available. Cancellation generally takes effect at the end of the current paid period unless stated otherwise. Deleting an Account or Workspace can permanently remove access and may be irreversible. Export data before deletion if you need it later.
We may suspend, restrict, or terminate access immediately if we reasonably believe Customer violated these Terms, created security, legal, payment, abuse, or deliverability risk, submitted unlawful content, failed to pay, or used the Service in a way that could harm Recipients, RouteKite, or other customers. Where practical, we will give notice, but urgent protective action may be taken without notice.
15. Ownership and confidentiality
RouteKite and its licensors retain all rights, title, and interest in the Service, documentation, software, designs, trademarks, branding, and related intellectual property. Customer receives only the limited right to use the Service under these Terms. Feedback may be used by RouteKite without restriction or compensation.
Each party may receive non-public information that a reasonable person would understand to be confidential. The receiving party will use it only to perform under these Terms and protect it using reasonable care. Confidential Information excludes information that becomes public without breach, was already known without a duty, was independently developed, or was rightfully received without a duty. Disclosure may be made when required by law, where legally permitted and reasonably practicable after notice.
16. Privacy and data protection
Our collection and use of personal information is described in the Privacy Policy. Customer is responsible for determining its privacy role with respect to Customer Data, providing required notices, obtaining a lawful basis, and meeting recipient rights. Where RouteKite processes Customer Data for a customer, RouteKite does so on the customer’s documented instructions as described in these Terms and the Service.
Do not submit special-category, highly sensitive, regulated, or protected data unless you have confirmed that the Service is suitable and have met every applicable legal requirement.
17. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUTEKITE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AVAILABILITY, AND QUIET ENJOYMENT.
ROUTEKITE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, AVAILABLE AT A PARTICULAR TIME OR LOCATION, FREE OF HARMFUL COMPONENTS, OR COMPATIBLE WITH EVERY DEVICE, DOMAIN, RECEIVING SYSTEM, OR THIRD-PARTY SERVICE. ROUTEKITE DOES NOT GUARANTEE DELIVERY, INBOX PLACEMENT, RECIPIENT ACTION, CAMPAIGN PERFORMANCE, REVENUE, OR ANY OTHER RESULT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUTEKITE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES. ROUTEKITE’S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS PAID TO ROUTEKITE FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT OR ONE HUNDRED U.S. DOLLARS.
18. Indemnity
Customer will defend, indemnify, and hold harmless RouteKite and its affiliates, officers, directors, employees, agents, licensors, and suppliers from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from Customer Data, Messages, Customer’s use of the Service, Customer’s breach of these Terms, violation of Applicable Law, or infringement or violation of another person’s rights.
RouteKite may control the defense and settlement of an indemnified matter, and Customer will reasonably cooperate. Customer may not settle a claim in a way that imposes liability, admission, or obligation on RouteKite without prior written consent.
19. General legal terms
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Subject to mandatory law that gives you different rights, the state and federal courts located in Travis County, Texas have exclusive jurisdiction over disputes, and each party consents to that jurisdiction and venue.
Customer may not assign these Terms without our prior written consent. RouteKite may assign them in a merger, acquisition, reorganization, sale of assets, or by operation of law. No waiver is effective unless in writing. If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest remains effective. These Terms and incorporated policies are the entire agreement about the Service.
20. Changes and contact
We may update these Terms to reflect changes in the Service, law, security practices, or business operations. For material changes, we will provide reasonable notice through the Service, email, or another reasonable method. Continued use after the effective date means acceptance. If you do not agree, stop using the Service before the update takes effect.
Questions about these Terms can be sent to support@routekite.com.
